The State of Medical Malpractice Payouts

I have written a few articles and blog posts about medical malpractice.  A company recently published a study of medical malpractice claims from 2012.  Some interesting findings are:
 
  • New York had the highest dollar amount of total payouts for 2012, $763,088, 250. 
  • 48% of all payouts came from only 5 states (New York, New Jersey, California, Florida and Pennsylvania). 
  • The vast majority of payouts were from settlements; only 5% of payouts made it to trial and were received from a judgement. 
  • Texas and North Dakota had the lowest, per capita payouts.
  • The highest percentage of malpractice claims were due to failure to diagnose.

  1. This also means that doctors in that area are the ones that have a higher tendency to be negligent in terms of looking at patient histories. I've even read about doctors not knowing how to use EMRs that caused them to overlook a patient's medical history. My friend was fortunate enough to have a reputable Arizona medical malpractice attorney to assist her in getting the compensation she deserves.

  3. The subject of medical malpractice is something that we really should look into. It's really a serious issue. People have been having qualms about consulting a doctor due to such instances. I think further study can be done as to whether the negligence is mostly caused by substandard medical education or just plain coincidence. Thanks for sharing!
